Please read these Terms & Conditions ("Terms") carefully before using GymLogs (the "Service"), operated by Kaustov kakoty ("GymLogs," "we," "us," or "our"), available at gymlogs.in.

By signing up for or using GymLogs, you ("Customer," "gym owner," or "you") agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

GymLogs is a business-to-business (B2B) software-as-a-service (SaaS) platform that helps gym owners manage members, track payments, create membership plans, send renewal reminders, and optionally host a public mini-website for their gym.

GymLogs is a tool provided to help gym owners run their business. GymLogs is not a party to any transaction, agreement, or membership arrangement between a gym owner and their own gym members.

2. Account Access

• GymLogs currently operates on an invite-only basis. Accounts are created only after GymLogs sends an invitation to a gym owner's email address.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must provide accurate and current information when setting up your account and gym profile.

3. Subscription Plans and Pricing

GymLogs currently offers the following subscription plans (subject to change with notice):

Both plans include full access to member management, payment tracking, plan management, WhatsApp reminders, push notifications, revenue dashboard, and the public mini-website with photo gallery, inquiry form, and Google Maps listing.

• Subscription fees are billed monthly.
• Payments may currently be collected manually (cash/UPI) or, where enabled, through our online payment partner, Razorpay.
• We reserve the right to change subscription pricing with reasonable advance notice to existing Customers.

4. Payment and Account Status

• Timely payment of subscription fees is required to maintain active access to the Service.
• If a payment is not received for the applicable billing period, GymLogs reserves the right to block or suspend account access until payment is made. Blocked accounts will display a notice with support contact options.
• Reactivation of a blocked account may require settlement of outstanding dues.

5. Customer Responsibilities

As a gym owner using GymLogs, you agree to:

• Enter accurate information about your gym and your members
• Obtain any consent required from your own gym members before entering their personal data (name, phone number, payment status) into the Service
• Use the Service only for lawful business purposes related to operating your gym
• Not attempt to reverse-engineer, resell, sublicense, or misuse the Service or its underlying code
• Not use the Service to store or transmit any unlawful, abusive, or harmful content, particularly on your public mini-website

You are solely responsible for your relationship with your own gym members, including membership agreements, refunds you offer them, and compliance with any local laws applicable to your gym business.

6. Public Mini-Website Feature

If enabled on your plan, GymLogs may generate a public web page for your gym containing information you provide (name, address, photos, facilities, pricing, contact details). You are responsible for the accuracy and appropriateness of all content you upload, including photographs and descriptions. GymLogs reserves the right to disable a mini-website that contains inappropriate, false, or unlawful content.

7. Intellectual Property

• GymLogs, including its software, design, branding, and underlying code, is the property of Kaustov kakoty. These Terms do not grant you ownership of any part of the Service.
• You retain ownership of the data you enter (your gym's information and your members' information), granting GymLogs only the limited right to process it in order to provide the Service to you.

8. Service Availability

• We aim to keep GymLogs available and reliable but do not guarantee uninterrupted or error-free operation. The Service is provided on an "as is" and "as available" basis.
• Scheduled maintenance, third-party outages (e.g., hosting or database providers), or unforeseen issues may occasionally affect availability.

9. Limitation of Liability

To the fullest extent permitted by law, GymLogs and its owner/operator shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to loss of business, revenue, or data. Our total liability for any claim relating to the Service shall not exceed the subscription fees paid by you in the three (3) months preceding the claim.

10. Termination

• You may stop using the Service and request account closure at any time by contacting us.
• We may suspend or terminate accounts for non-payment, misuse of the Service, or violation of these Terms.
• Upon termination, your data may be retained for a reasonable period as described in our Privacy Policy, and may be deleted thereafter.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. Material changes affecting pricing or core functionality will be communicated to active Customers in advance where reasonably possible.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Dibrugarh, Assam, India.
